Defense of Marriage Act (DOMA)

On June 26, 2013, The Supreme Court of the United States declared the Defense of Marriage Act (DOMA)
unconstitutional. Now same-sex marriages are now recognized under the law. As a result of this dramatic
decision, same-sex spouses can immediately begin filing the petitions or his/her same-sex spouse and
accompanying relatives which would provide them with employment authorization, travel permission, and may
even lead to legal permanent residence (green card). In addition, a same-sex spouse may even act as a
qualifying relative for other forms of relief for someone who is currently in removal proceedings.
While same-sex spouses are eligible for the same type of family-based immigration benefits as heterosexual
spouses, the filing of applications for same-sex marriage benefits is sure to raise legal issues as to how USCIS will
view the evidence in these “non traditional” cases.
